DOT audits are no joke. Non-compliance can cost your fleet thousands in fines, and in worst cases, can shut down operations. Here's everything you need to check before a driver hits the road. Source: FMCSA Regulations
Pre-Employment Screening Requirements
Before you even make an offer, you must complete these screening steps. Skip any of them and you're out of compliance. See also: Interview Questions Guide and Complete Recruiting Guide.
☑️ Drug Testing
- Pre-employment drug test (5-panel DOT: marijuana, cocaine, opiates, amphetamines, PCP)
- Negative result required before driver operates CMV
- Document in driver qualification file
- Keep results confidential and separate from other records
⚠️ Critical: Cannot put driver on the road until you have negative results in hand.
☑️ Alcohol Testing
- Pre-employment alcohol test required if you have a testing program
- Less than 0.04 BAC required
- Document in qualification file
☑️ Motor Vehicle Record (MVR) Check
- Check MVR from every state where driver held a license in past 3 years
- Review for disqualifying offenses
- Document review date and who performed it
- Pull annual MVRs for all drivers (not just new hires)
Disqualifying violations include: DUI, leaving scene of accident, felony involving vehicle, multiple serious traffic violations.
Driver Qualification File
Every driver needs a complete qualification file before operating a CMV. Here's what must be in it:
Required Documents:
- Application for Employment — Must include 10-year work history for CDL drivers
- Medical Examiner's Certificate — Current DOT physical, valid for up to 24 months
- CDL Copy — Valid commercial driver's license with proper endorsements
- Road Test Certificate — Or equivalent certificate from previous employer
- Drug Test Results — Negative pre-employment test
- MVR Checks — Initial and annual reviews documented
- Safety Performance History — Previous employer safety records (required for new CDL drivers)
- Driver's Certification of Violations — Annual list of all traffic violations
Previous Employer Checks (Critical)
For CDL drivers, you must check with previous employers from the past 3 years. This is where most fleets slip up.
What You Must Request from Previous Employers:
- Dates of employment
- Any accidents while employed there
- Any drug/alcohol violations
- Whether driver was subject to FMCSA drug testing
- Whether driver had any DOT-recordable accidents
Timeline: Must request within 30 days of hire. Must document attempts. Keep records for 3 years.
Medical Certification
DOT physicals are often overlooked until it's too late. Here's what you need to track:
- Medical examiner must be on FMCSA National Registry
- Certificate valid for 24 months (or less if medical condition requires monitoring)
- Driver cannot operate CMV without valid medical card
- Set up expiration alerts — 30 days, 15 days, and day-of
- Upload to driver's CDL record via state DMV (varies by state)
Ongoing Compliance (Don't Forget These)
Hiring is just the start. You must maintain these records for all active drivers:
Annual Requirements:
- ☐ Review MVR for each driver
- ☐ Document review and who performed it
- ☐ Get driver's annual list of violations
- ☐ Verify medical certificate still valid
- ☐ Road test certificate (if not on file)
Random Drug Testing Program:
- Minimum 50% of drivers tested annually for drugs
- Minimum 10% tested annually for alcohol
- Must use truly random selection process
- Document everything
